Two types of alimony
Spousal support is based upon financial need and can be awarded in two types of situations. Temporary spousal support is awarded during divorce proceedings, and often reflects that spouses need for support while returning to a regular job. Permanent spousal support is granted to spouses who will not be able support themselves financially. In most situations, the spouse who is receiving alimony can receive it for no more than three years. However if the spouse is disabled or is the caregiver of a special needs child, alimony may continue beyond three years.
What factors are considered in determining alimony?
The courts consider many factors when making an alimony determination. Our firm can protect your rights and advocate on your behalf. We strive to ensure that the amount of alimony you will be paying or receiving is fair and realistic. Factors used to determine alimony include the following:
- Length of the marriage – In most cases, support is not granted if the marriage lasted less than ten years.
- Domestic violence – If violence has been a factor in the divorce, support may be ordered.
- Financial need of spouse
- Ability of spouse to pay alimony
- Education, occupation and earning capacity of spouse receiving alimony
Whether you are trying to get alimony or ensure that you do not pay too much, our firm can help. Contact us today to arrange your consultation.
